Public Procurement Code

According to Public Procurement Code (PPC), approved by the Decree-Law No 18/2008, 29th January, re-published by the Decree-Law No 111-B/2017, 31st August, changed by Decree-Law No 30/2018, 7th May and by the Decree-Law No 60/2018, 3rd August, the rental and acquisition of goods or services, which are necessary to development of research and development and that also do not exceed the threshold amounts established in the Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014, are not subject to previous administrative public procurement.

In this context, and according the notification sent by the Board of Directors on 09th August 2018, it is established that:

  • The acquisitions of goods and services which cost is under 221.000,00€ are exempt of formal procedures (direct invitation, previous consultation and open procedure), allowing the direct contract award to the supplier;

  • The acquisitions of goods and services which cost is equal or above 221.000,00€ can be awarded under a procedure of previous consultation (invitation to 3 suppliers) or direct inviation (1 supplier);

  • If there is a formal procedure, the qualification documents do not require a translation into the Portuguese language, nor legalization.

 

However, in behalf of good financial management practices, the Board of Directors determined the implementation of the following procedural measures:

  • Orders can be placed directly to the supplier, for purchase of equipment, up to a maximum amount of € 20,000.00 per purchase (at this point, suppliers are no longer blocked). In order to identify the object of the contract, a CPV filter (groups 16; 30 to 39; 42; 43; 45 and 48) was considered in the ADP for Purchase Order.
  • Laboratory and related consumables (such as disposable pipettes, glassware, gloves, laboratory plastics, reagents, kits, filters, parts, etc.) may be purchased to any company, without limitation in terms of value and supplier.

 

Also, if the object of the acquisition is identified with one of the following CPVs, order notes of any value can be made directly to the supplier:

  • 73000000-2 Research and development services and related consultancy services
  • 73100000-3 Research and experimental development services
  • 73110000-6 Research services
  • 73111000-3 Research laboratory services
  • 73112000-0 Marine research services
  • 73120000-9 Experimental development services
  • 73200000-4 Research and development consultancy services
  • 73210000-7 Research consultancy services
  • 73300000-5 Design and execution of research and development
  • 73420000-2 Pre-feasibility study and technological demonstration
  • 73430000-5 Test and evaluation.

 

In the cases where it is still necessary to formalize in accordance with part II of the PPC, the principle investigator for the acquisition must complete the correspondet internal form " Minuta para abertura de procedimento_Bens e Serviços", and send it to CCMAR’s legal office (Teresa Pimenta, tapimenta@ualg.pt) who will appreciate the framework of the acquisition requested in the context of the current legal framework.
